Personal Injury Trial with $1.95M Pretrial Demand Ends in Defense Verdict


In a personal injury matter in which Plaintiff sought compensatory and punitive damages from our client for injuries he suffered while unloading heavy equipment from a flatbed trailer nearly six years ago, a Boone County, Missouri jury returned a defense verdict for our client after a three-day trial. 

At trial, Plaintiff claimed that during the unloading process, the equipment fell onto him, knocking him from the trailer to the ground, where he suffered various fractures and a traumatic brain injury. Plaintiff further argued Defendant should have shipped and/or loaded the equipment in a different fashion and trained the Plaintiff on how to unload the materials. Defendant denied those claims and asserted the accident was entirely Plaintiff’s fault.

 After their deliberation, the jury found the Plaintiff was 100% at fault for his own injuries.
