Baker Sterchi prevails on Appeal – Transfer of case out of Madison County, Illinois for Forum Non-Conveniens Affirmed


Suit was brought against a Baker Sterchi client in Madison County, Illinois, related to a vehicle/truck accident which occurred in Montgomery County, Illinois.  The plaintiff was likewise from Montgomery County.  For obvious reasons, she chose to file suit in plaintiff friendly Madison County.  Baker Sterchi attorneys filed a Motion to Transfer Venue for Forum Non Conveniens and prevailed, with Judge Matoesian finding no logical connection with Madison County.  Plaintiff appealed the transfer claiming there was enough connection with Madison County for the case to be heard there.  The Illinois Court of Appeals for the 5th District dismissed plaintiff’s appeal finding both no connection with Madison County and that the Appeal itself was not timely because a Motion to Reconsider does not toll the time to Request Leave to Appeal an Interlocutory Order in Illinois.
